Note that anyone under the age of 12 years cannot legally operate any vessel powered by a motor of more than 6 horsepower.<\/p>\n<\/div>\n<\/div>\n<p><!-- .et_pb_text --><\/p>\n<\/div>\n<p><!-- .et_pb_column --><\/p>\n<\/div>\n<p><!-- .et_pb_row --><\/p>\n<div class=\"et_pb_row et_pb_row_4023  et_pb_css_mix_blend_mode\">\n<div class=\"et_pb_column et_pb_column_4_4 et_pb_column_4389  et_pb_css_mix_blend_mode et-last-child\">\n<div class=\"et_pb_module et_pb_text et_pb_text_4280 h4-30 et_pb_bg_layout_light  et_pb_text_align_left\">\n<div class=\"et_pb_text_inner\">\n<h2>Boating and Alcohol<\/h2>\n<\/div>\n<\/div>\n<p><!-- .et_pb_text --><\/p>\n<\/div>\n<p><!-- .et_pb_column --><\/p>\n<\/div>\n<p><!-- .et_pb_row --><\/p>\n<div class=\"et_pb_row et_pb_row_4024  et_pb_css_mix_blend_mode\">\n<div class=\"et_pb_column et_pb_column_4_4 et_pb_column_4390  et_pb_css_mix_blend_mode et-last-child\">\n<div class=\"et_pb_module et_pb_text et_pb_text_4281 p2 et_pb_bg_layout_light  et_pb_text_align_left\">\n<div class=\"et_pb_text_inner\">\n<p>Vermont boating laws prohibit operating or being in physical control of a vessel while intoxicated by drugs or alcohol.<\/p>\n<p>The term \u201cvessel\u201d includes <em>\u201cevery description of watercraft, other than a seaplane on the water or a racing shell or rowing scull occupied exclusively by persons over 12 years of age, used or capable of being used as a means of transportation on water.\u201d<\/em>\u00a0<\/p>\n<p>You can be convicted of boating while intoxicated (BWI) for operating a vessel while:<\/p>\n<ul>\n<li>Under the influence of drugs or alcohol \u201cto a degree which renders the person incapable of operating safely,\u201d or<\/li>\n<li>having a blood alcohol concentration (BAC) of .08% or greater<\/li>\n<\/ul>\n<p>The consequences of a Vermont BWI depend on the circumstances of the case. But generally, the consequences are:<\/p>\n<ul>\n<li><strong>First, second, and subsequent offenses:<\/strong> Up to one year in jail. Whether it&#8217;s your fault or not, Vermont requires boaters to do a few things.\u00a0<\/p>\n<p>First, stop your vessel immediately at the scene.
